Key points
- Distinguish a contractual review from the annual review of wage rates.
- Prepare verifiable proposals and respect employees' freedom to decide.
- Connect the agreement, consultation and registration with payroll and operational implementation.
Establish the timetable and applicable agreement
Before negotiations begin, the current collective agreement, amendments, wage schedules and registration records should be assembled. The company needs to identify the establishments and employees covered, together with commitments whose implementation remains outstanding. An incomplete file may lead to negotiations based on benefits or rules that have already changed.
The Federal Labour Law distinguishes the contractual review governed by Article 399 from the annual review of daily cash wage rates under Article 399 Bis. The biennial contractual review addressed by Article 400 Bis requires approval by a majority of employees covered by the agreement through consultation. [1]
Prepare an economic and operational proposal
A precise proposal separates wages, benefits, working rules and implementation dates. The effect of each change should be calculated using explicit assumptions: the workforce covered, categories, payment frequency and eligibility conditions. The cost of a benefit does not always equal the amount stated in the relevant clause.
Implementation responsibilities also need review. Human resources may negotiate a condition whose application depends on payroll, production or systems. Involving those functions helps identify ambiguity and prepare consistent instructions. Economic assessment informs the employer's position; it neither replaces agreement nor authorises unilateral changes to existing obligations.
Respect consultation and each party's role
For a comprehensive review, the consultation procedure requires the agreed terms to be submitted to employees entitled to participate. The CFCRL guide distinguishes the union's tasks from the facilities the company must provide. Management should not replace the union in organising the process or influence how employees vote. [1] [2]
The company should designate a contact for logistical and documentary matters, separate those functions from managerial communications and avoid messages making benefits or employment conditional on the result. A clear explanation of the agreement must not become pressure. Incidents should be documented and referred through the appropriate channels.
Implement the agreement in business operations
The consultation, agreement and registration should form a coherent file. The official guide treats notification of results and registration as distinct stages; signature by the parties should not be regarded as completion of every formality. The status of the procedure should be confirmed before definitive conclusions are communicated. [2]
Once the applicable requirements have been met, implementation requires updated wage schedules, payroll configuration and checks against the agreed dates. Subsequent review can establish whether the conditions reached the correct workforce and whether contradictory versions remain in circulation. Negotiation thereby produces identifiable obligations and consistent administration of employment arrangements.
